|This goes to show that the legal, artistic and ethical dimensions are hard to untangle.
Maybe it does go back to "intention." I have a completely different response to the Aubrey Beardsley tarot, for example. Why? Because it shows more care and effort, and because I have a sense of the intention of the person who did it and an affinity for that intention--it does seem intended as a genuine tribute.
Consistency is a virtue (on those "what tarot card are you? quizzes I'm always Justice) but heck.
